Terms of Use
1. Agreement
These Terms of Use (“Terms”) are a binding agreement between you and Studio Bokeh AI LLC, a California limited liability company (“BDYWRK,” “we,” “us”), covering the BDYWRK iOS and watchOS app (the “App”) and the bdywrk.app website (the “Site,” together the “Service”). By downloading or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What BDYWRK is
BDYWRK tracks bodyweight workouts, counting reps automatically using your device’s sensors, and helps you follow goals, heart rate, and protein intake. Using the App requires a free BDYWRK account, which keeps your training synced and backed up. Some features require a Premium subscription; some features (such as social features) may not be available in every version of the Service.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules, and to use the Site for your personal, non-commercial use.
4. Health and safety notice
BDYWRK is not a medical device and does not provide medical advice, diagnosis, or treatment. All content is for general informational and fitness purposes only. This includes rep counts, heart-rate displays, calorie figures, and protein estimates.
- Consult a physician before beginning any exercise or nutrition program, especially if you have a medical condition, are pregnant, or have concerns about your health.
- Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or discomfort.
- You use the Service at your own risk and assume all responsibility for any physical activity you perform. We make no promises about results: fitness, strength, weight, or body-composition outcomes vary and are not guaranteed.
5. AI features and estimates
Rep detection, calorie figures, and AI protein estimates are automated approximations produced on your device and may be inaccurate or incomplete. They are not a substitute for professional nutrition or medical guidance, and you should verify any figure you rely on for health decisions.
6. Premium subscription
- Offer: “Ad-Free Yearly” is an auto-renewable subscription with a one-year period. It removes ads and unlocks the on-device protein estimator. The price shown in the App at the time of purchase governs.
- Billing: payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period; the renewal is charged within 24 hours before the period ends.
- Managing and canceling: manage or cancel anytime in your App Store subscription settings (Settings > your name > Subscriptions). Deleting the App does not cancel a subscription.
- Restoring: use “Restore Purchases” in the App to recover an active subscription on a new or reinstalled device.
- Refunds: purchases are processed by Apple, and refunds are handled by Apple under its policies at reportaproblem.apple.com.
7. Free tier and ads
The free tier is supported by advertising. Ads are described in our Privacy Policy; your health and workout data are never used for advertising.
8. Accounts
The App requires a BDYWRK account. When you create your account, you agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. You may delete your account at any time in the App or by emailing us. We may suspend or terminate accounts that violate these Terms.
9. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- reverse engineer, decompile, or disassemble the Service except to the extent permitted by law;
- extract, copy, or redistribute the App’s AI model (whether bundled with the App or downloaded), or any substantial portion of the Service’s content;
- interfere with the Service’s operation, probe its security, or access it by automated means (scraping, bots) without our written permission;
- infringe anyone’s rights, or harass or harm other users.
10. Your content (where available)
If social features are available, you keep ownership of content you submit (such as a display name, avatar, or activity you choose to share) and grant us a non-exclusive, worldwide, royalty-free license to host and display it solely to operate the Service. You are responsible for what you share, and we may remove content that violates these Terms.
11. Intellectual property
The Service is owned by Studio Bokeh AI LLC or its licensors and protected by law. This includes the App, the BDYWRK name and logo, and all content other than your content. The App includes open-source components used under their own licenses. If you send us feedback, we may use it without obligation to you.
12. Third-party services
The Service interoperates with third-party services such as Apple Health, the App Store, and Google’s advertising services. Your use of those services is governed by their own terms, and we are not responsible for them. You must comply with applicable third-party terms when using the Service.
13. App Store terms
These additional terms apply because the App is distributed through Apple’s App Store:
- These Terms are between you and Studio Bokeh AI LLC only. Apple is not a party to these Terms and is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App. Support is provided by us at support@bdywrk.app.
- If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App; any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
- In the event of a third-party claim that the App or your possession and use of it infringes intellectual-property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of the claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY MEASUREMENT OR ESTIMATE WILL BE ACCURATE.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STUDIO BOKEH AI LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.
16. Indemnification
You agree to indemnify and hold harmless Studio Bokeh AI LLC and its officers, members, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Service.
17. Termination
You may stop using the Service at any time by deleting the App and your account. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including 4, 5, 11, and 13–18) survive.
18. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
19. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms here with a new effective date and, for material changes, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
20. Miscellaneous
These Terms, with the Privacy Policy, are the entire agreement between you and us regarding the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
